The desired audience for this session focuses on tribes seeking to accomplish meaningful ecological outcomes at Superfund sites where they are involved. The discussion will describe the various avenues within the Superfund framework by which habitat restoration may be accomplished. Those avenues will include adherence to ARARs (specifically Clean Water Act, Endangered Species Act, Migratory Bird Treaty Act, Marine Mammals Protection Act), mitigation requirements, green remediation principles, context-appropriate design, and Natural Resources Damages Assessment. Real-world examples will be provided to illustrate how these approaches work at Superfund sites in diverse geographic settings. Participants in the session will gain an understanding of the available avenues for incorporating habitat restoration and related ecological outcomes within the Superfund framework, and they will learn how to effectively apply those avenues to achieve meaningful ecological outcomes. The session will emphasize how to incorporate more ecological objectives and outcomes directly into the remedy without having to rely solely on the Natural Resource Damages Assessment process. Presentation materials and a supporting annotated bibliography will be provided to participants.
